Terms of Service

Introduction

This End-User License Agreement and Terms of Service (“Terms”) is a legal contract between Rocket Digital Limited, a company incorporated in Hong Kong (collectively, “Rocket Digital,” “we,” “our,” or “us”) and you, the individual or entity who downloads, installs, registers for, or uses any Rocket Digital mobile or web application, website, plug-in, or related service (each, an “App,” and together with all associated documentation, updates, and support, the “Services”).

By clicking “Accept,” installing, or using any Service, you (a) acknowledge that you have read and understood these Terms, (b) agree to be bound by them, and (c) represent that you have the authority to bind yourself or the entity you represent. If you do not agree, do not download, install, or use any Service.

Not legal advice: These Terms are provided for your convenience. You should obtain independent legal advice to ensure compliance with all applicable laws and regulations.

License Grant

Subject to your continuous compliance with these Terms, Rocket Digital grants you a limited, non-exclusive, non-transferable, revocable license to install and use each App, in executable form only, on devices you own or control for your personal or internal business purposes.

Restrictions

You may not, and may not permit any third party to:

Modify, adapt, translate, reverse-engineer, decompile, or disassemble any part of the Services (except to the extent such restriction is prohibited by law).

Copy, reproduce, sublicense, sell, lease, or commercially exploit the Services or any content generated therein, except as expressly permitted by these Terms.

Interfere with security-related features or attempt to gain unauthorized access to the Services, servers, or networks.

Use the Services for unlawful, harmful, or discriminatory purposes or to infringe any third-party rights.

Submit or generate content that is illegal, harmful, defamatory, obscene, hateful, or otherwise objectionable.

Rocket Digital may suspend or terminate your access for violations of these restrictions.

User Content & Data

4.1 Your Inputs. When you upload text, images, audio, video, or other data (“Inputs”) to the Services, you represent and warrant that you own or have the necessary rights to those Inputs.

4.2 Generated Outputs. Subject to your compliance with these Terms, Rocket Digital grants you a worldwide, royalty-free license to use, reproduce, and display the content generated by the Services based on your Inputs (“Outputs”) for any lawful purpose. You are responsible for ensuring that your use of Outputs complies with applicable laws and does not infringe third-party rights.

4.3 Data Processing & Sharing. To provide the Services, Rocket Digital (i) stores and processes Inputs and related metadata, (ii) transmits them to third-party AI providers (including but not limited to OpenAI, Google, Stability AI, and other model vendors) for inference, and (iii) receives and stores Outputs. By using the Services, you consent to such processing and cross-border data transfers.

4.4 Privacy. We collect and use your personal data in accordance with our Privacy Policy, which forms part of these Terms. The Services are not directed to children under 13 (or the minimum age in your jurisdiction).

AI Content Generation & Prohibited Uses

Our Applications and Services may provide tools to create synthetic media (including text, images, and video) using generative artificial intelligence. By using these Services, you agree to the following strictly enforced guidelines across all our platforms:

Zero-Tolerance for Harmful Content: You are strictly prohibited from using our Services to create, upload, or share content that is illegal, sexually explicit, promotes hate speech, or depicts violence.

Deepfake & Impersonation Policy: You must not use our Services to create “deepfakes” or any non-consensual synthetic media that impersonates real individuals (including public figures, celebrities, or private citizens) for defamatory, deceptive, or harmful purposes.

Enforcement & Monitoring: We reserve the right to monitor user prompts and generated outputs to ensure safety. Any violation of these terms will result in an immediate and permanent account ban without a refund and, where required by law, reporting to relevant law enforcement authorities.

Nature of AI Outputs & Accuracy

You acknowledge that our Services utilize experimental generative models. As such:

Inaccuracies: AI-generated content may contain “hallucinations,” visual artifacts, factual inaccuracies, or unexpected results. Rocket Digital does not guarantee the realism, accuracy, or quality of any AI-generated output.

No Liability: Rocket Digital is not responsible for any claims, damages, or losses resulting from your use, reliance upon, or distribution of content generated by these AI models.

Third-Party Services & APIs

The Services may incorporate or link to third-party platforms, APIs, or content (e.g., OpenAI’s API). Rocket Digital does not control and is not responsible for third-party services. Your use of such services is subject to their separate terms and policies (including any content policy and usage limitations). Rocket Digital provides no warranty and accepts no liability for third-party services.

Subscription Plans, Trials & Payments

Some Apps offer free trials, subscription plans, or in-app purchases. Details of fees, billing cycles, renewal, and cancellation rights are presented in-app or in the relevant app-store listing. All payments are processed by the respective app store (Apple App Store, Google Play, etc.) or Rocket Digital’s authorized payment processor.

Intellectual Property

The Services, including all software, logos, trademarks, documentation, and underlying models, are the exclusive property of Rocket Digital or its licensors. Except for the limited license granted in Section 2, no right, title, or interest is transferred to you. Rocket Digital reserves all rights not expressly granted.

Disclaimers

“AS IS.” The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. Rocket Digital disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability.

No Guarantee of Outputs. AI-generated content may be inaccurate, offensive, or infringe third-party rights. You assume full responsibility for verifying the accuracy and legality of Outputs.

Availability. Rocket Digital does not guarantee uninterrupted or error-free operation of the Services.

Limitation of Liability

To the fullest extent permitted by law, Rocket Digital, its affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with the Services or these Terms, even if advised of the possibility of such damages. Rocket Digital’s aggregate liability shall not exceed the greater of (a) the amount you paid to Rocket Digital for the Service that gave rise to the claim during the 12 months prior to the event, or (b) HK $1,000.

Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the maximum extent permitted.

Indemnity

You agree to indemnify and hold harmless Rocket Digital, its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with (a) your use of the Services, (b) your Inputs or Outputs, or (c) your breach of these Terms.

Termination

These Terms remain in effect until terminated. You may stop using the Services at any time. Rocket Digital may suspend or terminate your access immediately if (a) you violate these Terms, (b) required by law, or (c) we cease offering the Services. Upon termination, your license ends and you must delete all copies of the Apps. Sections that by their nature should survive (e.g., disclaimers, limitation of liability) will survive.

Modifications

Rocket Digital may update these Terms from time to time. We will post the updated Terms and, if we make material changes, provide notice via the Services or email. Continued use after the effective date constitutes acceptance of the revised Terms.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (“HKSAR”), without regard to conflict-of-law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the HKSAR, unless otherwise required by applicable consumer-protection law.
